General Terms and Conditions

§ 1 Scope of Applicability, Customer Information
The following general terms and conditions govern the contractual relationship between Anlaufs Fruchtschutz GmbH, www.anlaufs-fruchtschutz24.de, the shareholders authorized to represent the company: Michael Anlauf, Stephan Anlauf, and the consumers and companies who purchase goods from our Shop. Conditions which deviate from or conflict with our terms and conditions will not be recognized by us.

§ 2 Conclusion of a Purchase Contract

1. The offers on the internet constitute a non-binding invitation to purchase merchandise.

2. You can add one or several items to the shopping cart. As you order, enter your details and payment and delivery preferences. By clicking the 'Order' button the offer is accepted with the conclusion of a purchase contract. A purchase contract can also be concluded per telephone or fax.

§ 3 Customer Information: Storing Your Order Data
We save your order information, including details concerning the concluded contract (type of merchandise, prices, etc.). The terms and conditions will be sent to you when you order, but they can also be accessed on our website. If you already have an account, by logging in you can access information on previous orders.

§ 4 Customer Information: Amendments
Any information entered before completion of the order can be amended  using the delete button. Whilst ordering, you will also be kept informed about options to revise input information. The ordering procedure can be terminated any time by closing the browser.

§ 5 Retention of Title
The purchased item shall remain our property until full payment of all due sums.

§ 6 Statutory Warranty Rights

1. The statutory warranty rights apply to our products.

2. Warranty for product users
The warranty claim period for defects in used products is one year, starting with the date you receive the goods. Exceptions to this are claims for compensation, claims for defects that we have fraudulently concealed, and claims concerning the quality of a product which we have guaranteed. For these exceptions, the statutory limitation periods apply. In the case where a different warranty period has been granted, the customer will be given the benefit of the longer warranty period.

3. Warranty for companies and businesses
The warranty claim period for defects in the purchased products expires one year after the transfer of risk. The following claims are exempted from this regulation:

- claims for damages
- fraudulently concealed defects
- where a different warranty period has been granted
- withdrawal from the contract in terms of Sections 445a, 478 BGB (German Civil Code)
- defects in construction materials and components, which have been used as foreseen in a construction and which have causd the defect.

These exceptions are subject to the statutory warranty claim period. In the case where a different warranty period has been granted, the customer will be given the benefit of the longer warranty period.

§ 7 Limitation of Liability
Liability for slightly negligent breaches of duty is excluded, as far as these do not include fundamental contractual duties, damage resulting from mortal or personal injury, injury to health or the violation of guarantees or of claims based on the German Product Liability Act (Produkthaftungsgesetz) are affected. The same is true for breaches of duty by our vicarious agents and our legal representatives. The contractual obligations include, in particular, the obligation to deliver the title and ownership. Further, the item being supplied will be provided free of material defects and defects in title.

§ 8 Place of Jurisdiction
Place of fulfilment and sole court of jurisdiction for all disputes arising from this contract is our place of business, if you are a merchandiser.

§ 9 Consumer information: Participation in Dispute Settlement Procedures
We are prepared to participate in a dispute settlement procedure in front of a recognized arbitration board.
